— Ethan BarnardHow criminal cases work in Henderson
Henderson has its own police department, its own courts, and its own prosecutors. Where your case goes depends on the charge.
Henderson is not Las Vegas. The city has its own police department — Henderson PD — and its own court system. If you were arrested by Henderson police or cited for an offense within Henderson city limits, your case does not automatically go to Las Vegas Justice Court. It goes to Henderson courts, which have their own judges, their own prosecutors, and their own way of handling cases.
Understanding this distinction is the first thing a defense attorney needs to get right. The prosecutor in Henderson Municipal Court is from the Henderson City Attorney's office, not the Clark County DA. Their policies on plea offers, diversion, and case resolution are different. The judges have different tendencies. The courtroom procedures have different rhythms.
Misdemeanors — Henderson Municipal Court
Located at 243 S. Water Street, Henderson. Handles all misdemeanor offenses committed within Henderson city limits — DUI, domestic battery, petty theft, drug possession, disorderly conduct, and similar charges. Prosecuted by the Henderson City Attorney. If Henderson PD arrested you for a misdemeanor, this is your court.
Felony preliminary hearings — Henderson Justice Court
Also at 243 S. Water Street. When Henderson PD arrests someone for a felony, the preliminary hearing is held here. The justice court judge determines whether there is probable cause. If probable cause is found, the case is bound over to the Eighth Judicial District Court in Las Vegas.
Felony trials — Eighth Judicial District Court
Located at 200 Lewis Avenue in downtown Las Vegas. All Henderson felonies that survive the preliminary hearing end up here for arraignment, motions, plea negotiations, trial, and sentencing. The Clark County District Attorney handles prosecution at this level, not the Henderson City Attorney.

Henderson PD arrests and investigations
Henderson police handle their own investigations. Knowing their procedures matters for your defense.
Henderson Police Department is a separate agency from the Las Vegas Metropolitan Police Department. They have their own patrol zones, their own detective units, their own DUI enforcement teams, and their own procedures for arrests, evidence collection, and report writing.
When we defend a Henderson case, we review the Henderson PD reports, the body camera footage from Henderson officers, and the specific procedures they followed. Did they have probable cause for the stop? Were field sobriety tests administered correctly? Was the blood draw conducted within the two-hour window? Were Miranda warnings given before custodial interrogation? Henderson PD officers make the same kinds of mistakes that Metro officers make — and those mistakes create the same kinds of defense opportunities.
DUI enforcement in Henderson is particularly active along major corridors like Boulder Highway, Lake Mead Parkway, and Green Valley Parkway. Henderson PD runs its own DUI checkpoints separate from Metro. If you were stopped or arrested at a Henderson checkpoint, the legality of that checkpoint and the procedures used are always worth scrutinizing.
Flat-fee pricing for Henderson criminal cases
Same pricing structure whether your case is in Henderson or Las Vegas. No hourly billing.
Liberators Criminal Defense charges a flat fee for every case. You know the total cost at the start — before you sign anything. Most cases start at $1,000 down. Payment plans are available on every case.
Henderson clients sometimes worry about paying extra for an attorney whose office is in Las Vegas. Don't. Our flat fee already accounts for appearances at the Henderson courthouse. There are no mileage charges, travel fees, or add-ons. The price you are quoted is the price you pay.
15 minutes from the Henderson courthouse
Close enough to appear in Henderson courts regularly. Downtown enough to handle everything else.
Our office at 400 S. 4th Street, Suite 500, in downtown Las Vegas is approximately 15 minutes from the Henderson Municipal Court and Henderson Justice Court at 243 S. Water Street. We appear in Henderson courts regularly — not as a special trip, but as part of the normal practice.
For Henderson clients, consultations happen at our Las Vegas office. It is a straight shot up the 515 from Henderson. All court appearances at the Henderson courthouse are handled in person. If your Henderson case gets bound over to the Eighth Judicial District Court for felony proceedings, that courthouse is two blocks from our office.
What to do if you were just arrested in Henderson
The first hours after an arrest in Henderson are critical. Here is what to do and what not to do.
Stay silent
Henderson PD officers will try to get you talking. Do not make statements, do not explain, and do not apologize. You have the constitutional right to remain silent. Use it. Politely tell the officers you are invoking your right to silence and want a lawyer.
Do not consent to searches
If Henderson officers ask to search your phone, car, or home — say no. They may have a warrant or claim an exception, but your refusal on the record preserves your ability to challenge the search in court later. Consenting to a search waives your Fourth Amendment rights for that search.
Call a criminal defense lawyer
You are entitled to a phone call. Use it to contact a defense attorney or a family member who can contact one. The sooner an attorney is involved, the better the chances of preserving evidence, getting favorable bail conditions, and identifying problems with the arrest early.
Do not discuss your case on the phone or with inmates
If you are booked into the Henderson Detention Center or transferred to the Clark County Detention Center, every phone call is recorded except calls to your attorney. Do not discuss the facts of your case. Do not talk to other inmates about your charges. Jailhouse informants are real and they testify.
Document everything you remember
As soon as you are released or have access to paper, write down every detail — the time and location of the arrest, what officers said, whether you were read your rights, how any search was conducted, the names or badge numbers of the Henderson PD officers involved, and whether body cameras were on. Details fade quickly. Your attorney needs them.
Show up for every court date
Your Henderson Municipal Court or Henderson Justice Court dates are mandatory. Missing a court date results in a bench warrant, bail revocation, and additional charges. It also makes your case harder to resolve favorably. If something prevents you from appearing, call your attorney immediately — before the court date, not after.
